Questions

Common questions

I missed the due date. Can I still file?
A belated return under Section 139(4) of the Income-tax Act, 1961 can be filed until 31 December of the assessment year, with a late fee under Section 234F (₹5,000, or ₹1,000 if total income is up to ₹5 lakh) and interest under Section 234A. Losses other than house property loss cannot be carried forward from a belated return (Section 80).
Which tax regime should I choose?
The new regime under Section 115BAC is the default. Individuals without business income can choose the old regime each year in the return; those with business income switch through Form 10-IEA. We compare both for your figures before filing.
How is an NRI taxed on NRO interest and rent?
Residential status is decided by days in India under Section 6. NRO interest and rent are taxable in India, and the payer deducts tax under Section 195. Where a tax treaty applies, relief is claimed under Section 90, with Form 67 for foreign tax credit.
I am buying property from an NRI. What tax must I deduct?
TDS under Section 195 on the seller's capital gain, not the 1% under Section 194-IA that applies to resident sellers. The seller can apply for a lower deduction certificate under Section 197 so that tax is deducted only on the actual gain.
Who has to pay advance tax?
Anyone whose tax for the year, after TDS, is ₹10,000 or more (Section 208), in instalments by 15 June, 15 September, 15 December and 15 March (Section 211). Resident senior citizens without business income are exempt (Section 207). Shortfalls attract interest under Sections 234B and 234C.
What happens if a TDS return is filed late?
A fee of ₹200 a day under Section 234E, up to the amount of TDS, and a possible penalty under Section 271H. Interest on late payment of TDS is charged under Section 201(1A).
